Overview

Kevin Cuddy brings large firm expertise and local knowledge to his commercial litigation matters. Clients with difficult problems rely on him to handle high-stakes cases and help them navigate complex legal issues. Kevin represents both plaintiffs and defendants on general commercial litigation matters, ranging from breach of contract and tort claims to oil and gas matters, among others. Clients in a wide array of industries—oil and gas, Alaska Native Corporations, healthcare, telecommunications, as well as more traditional commercial and retail—have relied on Kevin to help them obtain favorable results in Alaska courtrooms. He has advised many of Alaska’s largest companies on some of their most challenging cases.

Kevin began his legal career in Boston and has been practicing in Alaska’s state and federal courts since 2008. He serves as the pro bono coordinator for the firm’s Anchorage office.

Experience

  • Obtained summary judgment on personal injury lawsuit on North Slope regarding novel maritime law issues and “exclusive remedy” defense.
  • Successfully challenged a ruling by the Alaska Department of Environmental Conservation affecting our client's oil discharge plan, averting a potential multi-million-dollar impact. The administrative law judge ruled in our favor, leading to a revised agency decision without the costly conditions.
  • Served as lead counsel representing telecommunications company in a class action lawsuit brought by customers alleging a failure to meet service commitments. Obtained complete dismissal of claims.
  • Secured dismissal of lawsuit by Alaska Attorney General against the Alaska Legislature (as brought against its administrative services agency) on constitutional grounds.  Affirmed on appeal.  Taylor v. Alaska Legislative Affairs Agency, 529 P.3d 1146 (Alaska 2023).
  • Defended the Senate President and Speaker of the House in a lawsuit brought by a former legislator challenging the Alaska Legislature’s ability to choose the location of its 2019 special legislative session. Obtained outright dismissal.
  • Won summary judgment for statewide waste management company in lawsuit that alleged antitrust violations, “takings,” consumer protection violations, and statutory issues.
  • Secured a preliminary injunction in federal court for an independent pharmacy in Alaska facing supply termination by a pharmaceutical supplier. After prevailing in the trial court, we obtained a favorable settlement while the case was pending appeal.
  • Won dismissal of a class action against a telecommunications company in which plaintiffs claimed that the company failed to provide an adequate level of service. Plaintiffs brought claims under the Unfair Trade Practices and Consumer Protection Act and a variety of common law theories.
  • Representation of a major oil and gas company in a two-week evidentiary hearing, securing a denial of the government’s request to revoke the company’s probation due to alleged Clean Water Act violations.
  • Filed amicus briefs with Alaska Supreme Court on behalf of interested parties.
  • Representation of clients in various administrative proceedings, including winning summary judgment dismissal of alleged APOC reporting violations, filing amicus briefs in certificate of need determination matter, and handling a bid protest and appeal of a procurement decision.
