It’s Complicated,” litigators Corey Day and Matthew Segal look at a recent decision by the U.S. District Court for the Northern District of Texas that held two federal laws governing home distilling are unconstitutional. They note that the ruling does not make home distilling legal—instead, it would allow a home distiller to obtain a liquor license to produce spirits in their residence if they can comply with the myriad federal and state laws, criminal and otherwise, that regulate the production of spirits.
