In a new article for Bloomberg Law, Chris Wall discusses the ways in which employees’ increased leverage to negotiate salary and benefits in a tight labor market, combined with high employee turnover, are likely to impact equal pay litigation. For employers to stave off lawsuits, Wall, a partner in Stoel Rives’ Labor & Employment group, provides some suggestions for their consideration:

  • Conduct pay equity audits under attorney-client privilege and eliminate pay gaps among employees in similar positions, tout progressive pay policies.
  • Exercise care to not accidentally create possible pay equity liability as a byproduct of retention efforts.
  • Stay abreast of quickly evolving statutory requirements of each pay equity statute.
