What Employers Need To Know About California's New Minimum Wage
Attorney Bryan Hawkins authored an article for Law360 titled “Calif.'s New Minimum Wage: What Employers Need To Know.” In the article Hawkins discusses what employers in California can expect in the wake of the legislature’s recent passage of Senate Bill 3, which by 2023 increases the state’s minimum wage for employers of any size to $15.
Hawkins discusses:
- The history of increases in the minimum wage in the state
- The details of the phased roll-out of the higher minimum wage—to $15 per hour by 2022 for employers with 26 or more employees and by 2023 for employers with 25 or fewer employees
- The effect of SB3 on minimum salary requirements for exempt employees
- The effect of SB3 on existing local minimum wage law.
Hawkins concludes that although SB3 is “not good news” for California employers, for most “it is not cause for immediate shock, given its ultimate implementation date of 2023, its overlap with other local minimum wage laws, and the limited procedural protections meant to reign in unwarranted or fiscally devastating minimum wage increases.”
