In an article posted at Law.com, “‘That’s Not the Job’ for the DOL: Crop of Suits Against Biden Administration,” labor and employment partner Adam Belzberg offers his take on lawsuits brought against the U.S. Department of Labor over rules the department issued that extend collective bargaining rights to foreign farm workers who are working in the United States under the H-2A visa program.
Belzberg noted that because the National Labor Relations Act bars union activity by agricultural employees, the Department of Labor exceeded its authority by allowing H-2A agricultural workers to organize. “What these cases are saying is that it’s not for the DOL to do this—they’re overreaching,” Belzberg said.
