Thomas Braun Quoted on Implications for Manufacturers of New Minnesota Ban on ‘Forever Chemicals’

In a new article, Thomas Braun shared with Manufacturing Dive some considerations for companies in navigating Minnesota’s new law that, starting in 2025, will ban PFAS, or “forever chemicals,” from products sold, offered for sale, or distributed for sale in the state.

Following 2019 and 2021 bans of PFAS in firefighting chemicals and in food packaging, respectively, Minnesota will at first prohibit the sale, offer for sale, or distribution for sale of a limited list of products containing intentionally added PFAS, and in 2032 a more general prohibition on the use of PFAS will go into effect.

Braun, an environmental partner, offered some of his thoughts on companies reviewing the potential impact of the ban on their businesses: “I would certainly seek counsel to help determine whether the new law applies to me, what I need to do to comply with the law and how I can ensure I remain in compliance when it comes to using products from outside suppliers.”

Braun noted that regulators may require companies to conduct testing on their products and those of their suppliers in order to provide evidence demonstrating compliance with the new law.
