Solar Industry Magazine Quotes Tom Wood on Effect of Supreme Court Decision on CO2 Limits
Partner Tom Wood was quoted in Solar Industry magazine in an article titled “EPA Must Tread Carefully On Greenhouse Gas Rules After Supreme Court Decision.” The article discusses the recent U.S. Supreme Court ruling in Utility Air Regulatory Group v. EPA that limited the Environmental Protection Agency’s (EPA) ability to regulate greenhouse gases under the Clean Air Act.
Wood says that the ruling gave the EPA all the authority and tools it needs to regulate the coal-fired electrical generation industry—the major portion of greenhouse gas emitters—but for smaller emitters prevented it from repurposing established limits on pollutants for specifically regulating sources of greenhouse gases above set thresholds. “I view it as a really serious clampdown on EPA,” says Wood. “The EPA’s spin is, ‘We got what we wanted.’ But I think that the Supreme Court decision calls into question whether EPA was being too ambitious.”
