The spread of COVID-19 has impacted a variety of developments under the labor laws. Employers are facing tough questions about what must be bargained with their unions, and when. Protections for concerted activity continue to evolve, and the NLRB continues to look over everyone’s shoulder. The NLRB has decided to resume holding union elections – but precisely what rules apply are in flux. Employers need to be aware when employees may be protected when they walk off the job, even non-union employees or ones violating a no-strike agreement. In addition, the CARES act poses hidden poison pill labor issues for mid-sized businesses.
