Protections for concerted activity continue to evolve, and the NLRB continues to look over everyone’s shoulder. The NLRB has decided to resume holding union elections – but precisely what rules apply are in flux. Employers need to be aware when employees may be protected when they walk off the job, even non-union employees or ones violating a no-strike agreement. In addition, the CARES act poses hidden poison pill labor issues for mid-sized businesses.
