Timberlab to Develop Cross-Laminated Timber Manufacturing Facility in Millersburg, Oregon
Stoel Rives represented Timberlab in closing on the acquisition of a site in Millersburg, Oregon, for the development of a 190,000-square-foot manufacturing facility for the production of cross-laminated timber (CLT). CLT is a sustainable engineered wood alternative to traditional concrete and steel that allows for the construction of taller, larger, and more structurally efficient timber buildings. Timberlab plans to break ground on the new facility early this year. This deal was complex in that it required extensive land use review and special terms and conditions to address infrastructure and development incentives.
Real estate partner Chris Criglow and land use partner Dana Krawczuk led the team that counseled Timberlab. Chris negotiated the purchase and sale agreement for the property, an easement and maintenance agreement for a new access road, and a development agreement with the City of Millersburg, in addition to handling the real estate title and survey due diligence. Dana Krawzcuk, along with Merissa Moeller and Hayley K. Siltanen were instrumental in securing the gatekeeping land use approval necessary for the project to proceed, which involved a technical, rarely used, and heavily litigated provision of Oregon land use law. They successfully negotiated a settlement agreement with the opposition and obtained county approval for the land use application.
