Stoel Rives Air Team members have been involved in a broad variety of citizen suits and citizen driven litigation related to compliance with the federal Clean Air Act and state air programs. Representative projects include numerous union driven citizen suits alleging violations of new source performance standards, opacity requirements and excess emission reporting requirements.
Team members also work with sources to help respond to third parties seeking to challenge or influence the permit issuance process. Most often this type of citizen action derives from concerns such as land use or labor contracts that have little to do with environmental concerns but everything to do with whether a permit is issued on schedule. Sometimes these challenges are brought by a control equipment manufacturer belatedly trying to force a source to utilize its technology. We help sources anticipate and respond to these challenges. In addition, team members regularly assist industrial sources defend a new or existing permit against challenges by EPA or by environmental advocacy groups.
