Topic: Barring congressional intervention, the eDiscovery amendments will become effective on December 1, 2006. Organizations involved in litigation will have specific obligations regarding the preservation and production of electronically stored information.
In-house counsel will face new challenges:
- How will the new rules affect record retention policies?
- What practical steps should the company take now?
- What should the company do if litigation is threatened or commenced?
- How is a "litigation hold" implemented, and what are its effects?
Chris will summarize the new requirements and outline practical approaches for setting up and managing record retention programs, promoting compliance, and responding to eDiscovery in litigation. Chris is a litigation partner with Stoel Rives LLP in Seattle. He is the past chair of firm's Litigation Practice Group.
