New Ammunition For Securities Fraud Defendants

U.S. Sentencing Commission statistics show that federal guidelines continue to drive sentencing decisions. However, a recent Supreme Court decision provides ammunition to minimize their clients’ exposure under the guidelines, at least with respect to securities fraud prosecutions.

In their article, "Reexamining ‘Loss’ And ‘Gain’ In The Wake Of Dura Pharmaceuticals v. Broudo — New Ammunition For Securities Fraud Defendants," Stoel Rives principals David Angeli and Per Ramfjord examine the impact of Dura and Olis on future criminal securities fraud and insider trading prosecutions. The article appears in the May 2006 issue of The Champion magazine, the journal of the National Association of Criminal Defense Lawyers (NACDL).
