We approach our products liability cases as we do our other complex litigation—through a strategic method of analysis and preparation. First, we undertake a critical evaluation of the factual and legal merits of the case. Based on that work, we create case maps that include an analysis of potential motions we may make or anticipate receiving; prepare a discovery plan; plan for electronic management of documents, transcripts and other evidentiary material; outline trial preparation strategies; and include settlement valuations and strategies, if appropriate. This process provides a useful framework to assist us in providing substantive advice to the client and also serves as the basis for developing a meaningful litigation budget.
We frequently involve jury consultants in the process of formulating case strategies and to test various approaches prior to dispositive phases of cases and trials.
