Labor and Employment Law Alert: Ricci v. DeStefano—Supreme Court Holds City Violated Title VII By Rejecting Racially Disparate Test Results

The Supreme Court today issued its long awaited ruling in Ricci v. DeStefano, holding that the City of New Haven violated Title VII by failing to endorse the results of a promotion test that disproportionately favored white employees. This case is getting significant attention due to Supreme Court nominee Sonia Sotomayor deciding the case in the city's favor while she served on an appellate court, the Second Circuit. The Supreme Court reversed that decision and although this case should have a minimal impact, employers should be aware of how Ricci may affect them down the road.
