Compliance and Regulatory

The health care industry in general, and hospitals in particular, are subject to numerous additional regulations imposed by state and federal agencies. Because we have represented hospitals and other health care providers for many years, we are familiar with these regulations and are able to advise hospitals in navigating the various requirements. Some of the regulatory areas we are experienced with include:

  • Compliance plans
  • Facility and professional licensing requirements
  • Certificate of need. We assisted a client in obtaining a certificate of need to build the first new hospital in Portland in more than 20 years.
  • Child, elder abuse and licensensee misconduct reporting requirements
  • Consent to treatment, including minors, incompetent adults, and special consent situations (end of life, mental health treatment)
  • Regulation of risk bearing entities, including health care service contractors, and more recently, accountable care organizations
  • Pharmacy regulation and DEA registration requirements
  • Provider contracting requirements including risk contracting arrangements, such as capitation, share of premium and multi-tiered risk pools
  • Medicare and Medicaid Provider enrollment and Conditions of Participation
